Terms of Service

1. Acceptance of Terms

By accessing or using any product or service ("Services") operated by Nascence Consulting LLC ("Company", "we", "us"), including OpenClaw and Voice Assistant, you agree to be bound by these Terms of Service. If you do not agree, do not use the Services.

2. Description of Services

OpenClaw provides hosted AI assistant instances powered by leading language models via OpenRouter. Each subscriber receives a dedicated instance accessible via a unique HTTPS subdomain with token-based authentication.

Voice Assistant provides AI-powered phone receptionists for businesses, including a dedicated phone number, automated call handling, appointment booking integration, caller management via a CRM dashboard, and business knowledge extraction from your website and other sources.

3. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activities under your account. Notify us immediately of any unauthorized use.

4. Subscriptions & Billing

Paid plans are billed monthly via Stripe. Your subscription renews automatically unless canceled before the current billing period ends. Cancellation takes effect at the end of the current period; no partial refunds are issued. We reserve the right to change pricing with 30 days' notice.

Voice Assistant subscriptions include a monthly minute allowance. Usage beyond the included minutes is billed at the per-minute overage rate for your tier. One-time setup fees are non-refundable.

5. Acceptable Use

You agree not to:

  • Use the Services for any illegal purpose or to violate any laws
  • Attempt to gain unauthorized access to other users' accounts or instances
  • Interfere with or disrupt the Services infrastructure
  • Use the Services to generate harmful, abusive, or deceptive content
  • Use Voice Assistant for robocalling, spam, or automated mass dialing
  • Resell or redistribute access without written permission
  • Exceed the resource limits of your subscription tier

6. Data & Storage

OpenClaw workspace data is stored on our infrastructure for the duration of your subscription. Upon cancellation, your instance and associated data will be deleted within 30 days. You are responsible for exporting any data you wish to keep before cancellation.

Voice Assistant call recordings, caller information, and business knowledge data are retained for the duration of your subscription. Call recordings are used to provide call summaries and analytics. Business knowledge extracted from your website is used solely to power your AI receptionist and is not shared with other customers.

7. Service Availability

We strive for high availability but do not guarantee uninterrupted access. The Services are provided "as is" without warranties of any kind. We are not liable for any downtime, data loss, missed calls, or damages arising from your use of the Services.

8. Limitation of Liability

To the maximum extent permitted by law, Nascence Consulting LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or business opportunities, arising from your use of the Services. Our total liability shall not exceed the amount you paid in the 12 months preceding the claim.

9. Termination

We may suspend or terminate your account if you violate these Terms. You may cancel your account at any time through the billing dashboard or by contacting support.

10. Changes to Terms

We may update these Terms from time to time. Continued use of the Services after changes constitutes acceptance of the new Terms.
